Terms of Service

By accessing or using NYMM ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. The most current version is always available at nymm.me/terms.

You must be at least 18 years old to use NYMM. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

NYMM is an AI Digital Twin platform that allows creators ("Creators") to build AI-powered conversational personas ("MEs") trained on information they voluntarily provide. Visitors ("Fans") can interact with these MEs via a chat interface.

All responses generated by a ME are produced by artificial intelligence. They do not represent real-time thoughts, opinions, or statements of any real person. Interactions with a ME are for entertainment and informational purposes only.

As a Creator, you agree to:

• Only submit training content that you own or have the right to use.
• Not submit content that is false, defamatory, harassing, or illegal.
• Not impersonate another real person (living or dead) without their explicit written consent. Creating a ME that mimics a public figure, celebrity, or third party without authorization is strictly prohibited and may result in immediate account termination.
• Not submit content that is sexually explicit, violent, or harmful.
• Ensure your ME persona does not provide professional advice (medical, legal, financial, or psychological) as though it were qualified to do so.
• Comply with all applicable laws, including data privacy regulations.

You retain ownership of the content you submit. By submitting it, you grant NYMM a non-exclusive, worldwide, royalty-free license to process, store, and use that content solely to operate and improve your ME.

As a Fan using a ME, you agree to:

• Understand that you are chatting with an AI, not the real person the ME represents.
• Not attempt to extract personal, private, or sensitive information about the real Creator through the ME.
• Not use the ME to generate illegal, abusive, or harmful content.
• Not reverse-engineer, scrape, or abuse the Service via automated means.
• Not share ME conversations out of context in a way that misrepresents the Creator or the AI-generated nature of responses.

NYMM offers paid message credits that allow Fans to continue conversations beyond the free tier. Payments are processed by Stripe, Inc. By making a purchase, you also agree to Stripe's Terms of Service.

Revenue from credit purchases is split 70% to the Creator and 30% to NYMM. Payouts to Creators are subject to Stripe Connect's payout schedule and terms.

Refund Policy: All purchases are final and non-refundable, except where required by applicable law. If you experience a technical issue that prevents credit delivery, contact us at contact@nymm.me within 7 days.

Unused credits do not expire but have no cash value and cannot be transferred or redeemed for cash.

NYMM's AI-generated responses are produced by large language models (currently Groq Llama 70B and OpenAI GPT-4o). Responses may be inaccurate, incomplete, or outdated. They do not constitute professional advice of any kind.

NYMM does not guarantee that any ME will accurately represent any real person's current views, opinions, or knowledge. Users should exercise independent judgment and not rely on ME responses for important decisions.

You may not use NYMM to:

• Violate any applicable law or regulation.
• Generate, distribute, or solicit sexually explicit content involving minors.
• Harass, threaten, or harm any individual.
• Spread misinformation, disinformation, or engage in fraud.
• Conduct automated scraping, crawling, or data harvesting without prior written approval.
• Attempt to circumvent rate limits, paywalls, or security measures.
• Use the Service in any manner that could damage, disable, or impair NYMM infrastructure.

Violation of these prohibitions may result in immediate suspension or permanent termination of your account without notice or refund.

All NYMM branding, software, design, and platform infrastructure is owned by NYMM and protected by applicable intellectual property laws. You may not copy, reproduce, redistribute, or create derivative works from any NYMM-owned materials without explicit written permission.

We reserve the right to suspend or terminate any account at any time, with or without cause, including for violation of these Terms. You may delete your account at any time via Settings or by contacting us at contact@nymm.me.

Upon termination, your ME and associated training data will be deleted within 30 days. Any pending Creator payouts that have already cleared in Stripe will still be paid out per Stripe's schedule.

To the maximum extent permitted by law, NYMM and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service.

Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the greater of (a) the amount you paid to NYMM in the 12 months preceding the claim, or (b) $10 USD.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved informally by contacting us at contact@nymm.me. If not resolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in English.

You waive any right to participate in a class action lawsuit or class-wide arbitration.
